Privacy notice

This privacy notice covers the Financial Intelligence Unit, which sits within the Department for the Economy.  

The Financial Intelligence Unit is registered as a Controller under the Data Protection (Jersey) Law 2018 (Data Protection Law), as we determine the purpose and means of the processing of the personal information collected about you for this service.

About the Financial Intelligence Unit - Jersey

The Financial Intelligence Unit (FIU) - Jersey is responsible for receiving, gathering, storing, analysing and disseminating information about financial crime; receiving suspicious activity reports and other disclosures of information about financial crime; and assisting with the prevention and detection of financial crime.

The purposes for which we process personal data are determined in accordance with our statutory function, as set out in Proceeds of Crime (Jersey) Law 1999 and Proceeds of Crime (Financial Intelligence) (Jersey) Regulations 2015, as amended.

As a directorate within a Government Department, we generally process and hold your information in order to provide public services and meet our statutory obligations. This notice explains in more detail how we use and share information relating to you (your personal data) in order to provide the service described above.

How we collect information about you

Your personal data will sometimes be collected directly from you. This may be done in any of the following ways:

  • By you telephoning, mailing or emailing us directly;
  • When you report suspicious activity through our online portal;
  • When you attend one of our events;
  • When you visit our premises, which have CCTV coverage.

In some cases, we may collect information about you from another Government of Jersey department or from the following third parties with which we interact in order to deliver our duties:

  • Any member of the regulated sector;
  • States of Jersey Police (SOJP);
  • The Honorary Police;
  • Jersey Customs and Immigration Service (JCIS);
  • Law Officers’ Department (LOD);
  • Jersey Financial Services Commission (JFSC);
  • Channel Islands Financial Ombudsman (CIFO);
  • Jersey Cyber Security Centre (JCSC);
  • International law enforcement agencies and bodies;
  • HM Revenue and Customs (HMRC);
  • Members of the Egmont Group of Financial Intelligence Units;
  • Legal representatives;
  • Security companies;
  • Partner agencies involved in anti-financial crime strategies;
  • Private sector organisations involved in anti-financial crime strategies;
  • Central UK government, governmental agencies and departments;
  • The media;
  • Websites and search engines.

Types of information we collect

The types of personal data collected will vary depending on what information you volunteer and the information we need in each circumstance. However, we have listed below the most common categories of information we may collect about you:

  • Contact details such as name, address, phone number, and email address;
  • Organisation details such as name of organisation, occupation, job title or role;
  • Information such as dates and place of birth, nationality;
  • Financial information;
  • Information on alleged or confirmed criminal activity;
  • Technical metadata such as IP addresses, usage data on software, systems and the internet;
  • Publicly available information, such as information collated from public reports and data feeds, which may include information on individuals;
  • Preferences such as dietary requirements, opinions or views;
  • Voluntary information, such as unsolicited information you may provide to us when you engage with us.

How we will use the information about you

We need to collect and hold personal data about you, in order to carry out the public functions of the FIU. Our legal basis for processing personal data in most cases is that it is necessary for the exercise of the FIU function of the States or any public authority (Schedule 2 para 4(c) of the Data Protection Law).

Who we may share your personal information with

Other data controllers

We may need to pass your personal data to other Government of Jersey Departments or the following organisation for the purposes stated above:

We may also disclose information to other public authorities where it is necessary, either to comply with a legal obligation, or where required under other legislation. Examples of this include, but are not limited to:

  • Where the disclosure is necessary for the purposes of the prevention or detection of crime;
  • For national security purposes;
  • For the purposes of meeting statutory obligations;
  • Prevent risk of harm to an individual.

Service providers

Your personal data may be processed on our behalf by certain third parties who provide service to us, so that they can provide those services. We have strict contracts in place with these service providers to ensure they process your data only on our instructions and with appropriate security in place. The categories of third parties who may receive your personal data in order to provide us with a service are:

  • Email and data storage providers such as Microsoft;
  • IT support and security service providers;
  • Online service providers.

At no time will your information be passed to organisations for marketing or sales purposes or for any commercial use without your prior express consent.

Publication of your information

We may need to publish your information on our website or through Government of Jersey channels for the reasons set out below. This will not include your personal data:

  • Where we are required by law to publicise certain information;
  • Where we are required to provide statistical information about a group of people; in such circumstances, your data will be anonymised to protect your identity;
  • Where you have responded to a consultation and have granted express permission to publish your information in a private capacity or on behalf of an organisation – views and connection with the organisation may be attributed.

How long do we store the information about you

We will keep your personal data accurate and up to date and not keep it for longer than is necessary for us to do so for the purposes for which the data is processed. Ask to see our retention schedule for more information about how long we retain your information.

Where do we store the information about you

Government of Jersey systems store data in Jersey, the UK and the European Union. The UK has been granted adequacy status by the European Commission and personal data stored there will be protected to the same standards as personal data held in Jersey and the EU.

In some instances, we may be required to transfer your personal data outside Jersey and the European Economic Area, if the recipient is located outside these jurisdictions. We do this when we share information with UK national security authorities and with members of the Egmont Group of Financial Intelligence Units, which are outside the European Economic Area, or are in jurisdictions without an adequacy decision from the European Union. However, we shall only do this with the necessary safeguards in place and where it complies with the Data Protection Law. Cookies are small text files that are placed on your computer by websites that you visit. They are widely used in order to make websites work, or work more efficiently, as well as to provide information to the owners of the site. Links on our website may lead to other websites which are not under our control. Using these links does not mean these organisations can access information about you which is held by the FIU or States of Jersey.

This privacy policy only covers the FIU-Jersey website (www.fiu.je). Websites linked to, and from, this site are not covered by this policy, so you should always read the privacy statement on that website.

The FIU is not responsible for the content of external websites.

Google Analytics

We use Google Analytics to help us understand how you engage with our website so that we can continually improve your experience.

When you visit fiu.je your browser automatically sends certain information to Google. This includes, for example, the web address of the page that you're visiting and your IP address.

Facebook pixel

We use Facebook pixel for marketing purposes. The Facebook Pixel is used for Facebook Ads and Facebook Analytics. It does use private data and you will need to ask for prior consent. Facebook has also implemented flexible ways for their users to see and control how the pixel is used on partner websites.

The Facebook pixel receives these types of data:

  • HTTP Headers: anything present in HTTP headers. HTTP Headers are a standard web protocol sent between any browser request and any server on the internet. HTTP Headers include IP addresses, information about the web browser, page location, document, referrer and person using the website
  • pixel-specific data: includes Pixel ID and the Facebook Cookie
  • button click data: includes any buttons clicked by site visitors, the labels of those buttons and any pages visited as a result of the button clicks
  • optional values: developers and marketers can optionally choose to send additional information about the visit through conversion tracking. Example custom data events are conversion value, page type, and more
  • form field names: includes website field names like 'email', 'address', 'quantity' for when you purchase a product or service. We don't capture field values unless you include them as part of Advanced Matching, conversion tracking, or user properties

IP address

Your computer’s IP address is a number assigned to your computer when you use the internet. This is recorded automatically in a log file when you visit our site. This log file does not contain any personal identifiable information about you.

We will not pass your information to organisations for marketing or sales purposes or for any commercial use without your prior express consent.

Statutory or contractual obligations to provide personal data

You are obliged under the following legislation to provide us with personal data as set out in the table above.

Your rights

See your personal data rights for details of your rights under the Data Protection Law and how to exercise them. These rights will be subject to the exemptions in the Data Protection Law, which apply to the functions of the Financial Intelligence Unit. This means that some of the rights outlined will not apply.

Withdrawal of consent

Where we rely on your consent to process personal data (see section 3 above), you can withdraw your consent by contacting  fiu.admin@jersey.police.je

If you have an enquiry or concern regarding processing your personal data you can contact the Central Data Protection Unit.

If you want to make a complaint about how your personal data is processed, you can email the Government’s Data Protection Officer at DPO@gov.je.

If you believe that the Financial Intelligence Unit has contravened the Data Protection Law and the contravention affects your data protection rights, you have the right to make a complaint at any time to the Jersey Office of the Information Commissioner (JOIC).

We would, however, appreciate the chance to deal with your concerns before you approach the JOIC, so contact the DPO in the first instance.
